Terms and Conditions
Demo notice: This is a demo site by madevisible.io. There is no real insurance broker and no real company, and nothing sits behind the forms. The texts below are example texts, lightly adapted from our template base, not reviewed legal advice. They are for showcase purposes only and not suitable for real legal transactions. A real insurance broker needs different texts here.
§ 1 Scope and contracting party
These Terms and Conditions apply to all contracts you conclude through this website with [Legal entity name pending], Sample Street 1 (Demo), 8000 Paphos, Cyprus.
A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession (§ 13 BGB).
§ 2 Conclusion of contract
The presentation of products on this website is not a legally binding offer, but an invitation to order. By submitting your order via a button clearly labelled "order with obligation to pay" or an equivalent wording, you make a binding offer (§ 312j(3) BGB). The contract is concluded when we accept your order by way of an order confirmation in text form or grant you access. The language of the contract is English.
§ 3 Subject matter of the service
The contract is a contract for a digital service within the meaning of § 327(2) sentence 2 BGB. For the term of the contract we owe you ongoing access to a platform with interactive elements, not the one-off delivery of a specific file.
§ 4 Prices and payment
All prices are final prices in euros and include statutory VAT where applicable. Payment is processed via the payment provider Stripe. For recurring payments you authorise us to collect the amount due via the stored payment method.
§ 5 Term
For a subscription, the contract renews for an indefinite period after the agreed initial term and can be terminated by either party at any time with one month's notice, via this website's cancellation page, without needing to log in.
§ 6 Right of withdrawal
Consumers have a statutory right of withdrawal. Details are set out in our withdrawal notice.
§ 7 Remedies for digital products
We provide the digital product free of product and legal defects under §§ 327d et seq. BGB. If the product is defective, you may request cure and, under the statutory conditions, terminate the contract or reduce the price.
§ 8 Liability
We are liable without limitation for intent and gross negligence, for injury to life, body or health, and under the Product Liability Act. Otherwise, liability is limited to foreseeable damage typical for this type of contract. No specific economic, health or professional outcome is owed.
§ 9 Dispute resolution
Consumers looking for help with out-of-court dispute resolution can find an overview of the competent bodies at consumer-redress.ec.europa.eu. We are not willing or obliged to participate in dispute resolution proceedings before a consumer arbitration board.
§ 10 Final provisions
The law of the state in which [Legal entity name pending] has its registered seat (Cyprus) applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer with your habitual residence in another state, the mandatory provisions of that state remain unaffected (Art. 6 Rome I Regulation). Should any provision be invalid, the remainder of the contract remains in effect.
